Terms of Service

Welcome to tinyposter. These Terms of Service (the “Terms”) are a binding agreement between you and Franc & Eli, LLC, a South Carolina limited liability company that operates tinyposter (“tinyposter,” “we,” “us”), and govern your access to and use of the tinyposter website, dashboard, MCP server, APIs, and related services (collectively, the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
tinyposter is a social posting and scheduling tool. We let you connect third-party social accounts (such as X, Threads, Bluesky, Facebook, Instagram, LinkedIn, TikTok, and others available through our publishing partner) and schedule or publish posts to them. We also provide an MCP server so you can drive the Service from compatible AI tools.
2. Eligibility and accounts
You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. You agree to provide accurate account information and to keep it up to date. You are responsible for everything that happens under your account, including content posted from connected social accounts and any actions taken through MCP tokens you have generated.
You are responsible for keeping your password and any MCP bearer tokens secret. If you believe a token has been compromised, revoke it from your dashboard immediately.
3. Plans, billing, and refunds
Paid plans are billed monthly in advance through Stripe. Your post quota resets at the start of each billing period and unused posts do not roll over. You may cancel at any time and will keep access through the end of the period you have already paid for.
We do not offer pro-rated refunds for partial months. If you believe you have been charged in error, contact us at hello@tinyposter.app and we will review the charge in good faith. We may change pricing on a go-forward basis with reasonable notice; existing billing periods will not be affected.
Taxes are your responsibility unless we are required by law to collect them. Failed payments may result in your subscription being downgraded or cancelled.
4. Your content
You retain ownership of the content you create, schedule, or publish through the Service (“Your Content”). You grant tinyposter a limited, worldwide, non-exclusive, royalty-free license to host, store, transmit, display, and otherwise process Your Content solely as needed to provide the Service to you, including delivering it to the third-party platforms you have connected.
You represent that you have the rights necessary to post Your Content and that it does not infringe any third party's rights.
5. Third-party platforms
Publishing relies on social platforms (such as X, Threads, Bluesky, Meta, LinkedIn, TikTok) and on our publishing partner Bundle.social. Your use of those platforms is governed by their own terms and policies. We do not control them and are not responsible for their availability, rate limits, content moderation decisions, or account actions (including suspensions). When you connect an account, you authorize us, through our publishing partner, to publish on your behalf.
6. Acceptable use
You agree not to use the Service to:
- send spam, malware, phishing, or unsolicited bulk messages;
- harass, threaten, defame, or impersonate others;
- publish content that is illegal, infringing, or sexually exploitative of minors;
- violate the terms of any connected social platform;
- attempt to reverse engineer, probe, or disrupt the Service or its infrastructure;
- resell or sublicense the Service without our written permission.
We may remove content or suspend accounts that violate these rules, particularly when required by law or by a connected platform.
7. MCP and API access
MCP and API tokens are scoped to your account and inherit your plan's quotas. You are responsible for requests made with your tokens, including those issued by AI agents you connect. We may apply reasonable rate limits to protect the Service.
8. Service availability
We work to keep the Service available, but we do not promise it will be uninterrupted or error-free. Scheduled maintenance, third-party outages (including platform or hosting outages), and bugs may cause delays or failures in scheduled posts.
9. Disclaimers
The Service is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.
10. Limitation of liability
To the maximum extent permitted by law, Franc & Eli, LLC and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to the Service. Our total aggregate liability for any claim arising out of or related to the Service will not exceed the greater of (a) the amounts you paid us in the twelve months preceding the claim or (b) one hundred US dollars.
11. Indemnity
You agree to defend, indemnify, and hold Franc & Eli, LLC harmless from any claim, loss, or expense (including reasonable attorneys' fees) arising out of Your Content, your use of the Service, or your violation of these Terms.
12. Termination
You may delete your account at any time from the dashboard. We may suspend or terminate your access if you violate these Terms, if required by law, or if continuing to provide the Service to you would expose us or other users to material risk. On termination, scheduled posts may not be delivered and you remain responsible for any amounts already owed.
13. Changes to the Service or these Terms
We may change the Service, including adding, removing, or modifying features. We may update these Terms; if we make material changes we will notify you (for example, by email or an in-app notice) before they take effect. Continued use of the Service after the changes take effect means you accept the updated Terms.
14. Governing law and disputes
These Terms are governed by the laws of the United States and the State of South Carolina, without regard to conflict-of-laws principles. The exclusive venue for any dispute that cannot be resolved informally is the state or federal courts located in South Carolina, and you consent to jurisdiction there. Nothing in this section limits any non-waivable consumer rights you have under your local law.
